§2. Scope of application & definitions

These Terms & Conditions set out the conditions for the provision of electronic services, account registration, placing orders, and the conclusion and performance of distance sales contracts for goods offered by the Seller to consumers within the European Union.

The following terms have the meanings given below:

  • Customer – a natural person with full legal capacity making a purchase for purposes unrelated directly to their business or professional activity (consumer), or, where expressly provided, a business entity.
  • User – a person who has registered an account in the Service.
  • Goods – nicotine pouches and accessories related to their use.
  • Order – a declaration of intent by the Customer aimed directly at concluding a sales contract.
  • Account – the User's personal panel within the Service.
  • Carrier – the entity selected by the Customer or indicated by the Seller to perform the shipment.
  • Country of destination – the EU member state to which the Goods are delivered at the Customer's request.

§3. Language, governing law & jurisdiction

Contracts are concluded in Polish, English, or any other language made available in the Service. In the event of discrepancies, the Polish version shall prevail.

Contracts concluded with consumers are governed by the law of the consumer's country of habitual residence, including mandatory consumer protection provisions of that country.

The consumer may bring proceedings before the courts of either their country of habitual residence or the country in which the Seller is established. The consumer may also use the ODR platform: ec.europa.eu/consumers/odr.

§4. Access to the Service, account & registration

Account registration is voluntary, but may be required in order to place an order. The User is obliged to provide accurate and up-to-date information and to keep their login credentials confidential.

The Seller may refuse to create an account or conclude a contract where there is reasonable suspicion of false information, a breach of these Terms, or an attempted misuse.

§5. Product information & safety

The Goods offered in the Service are nicotine pouches intended exclusively for adults. The product contains nicotine – an addictive substance. Not intended for consumption or for use by pregnant women.

Store in a dry, cool place out of reach of children and pets.

Product images and descriptions are for informational purposes only and may differ slightly from the final product. Colours may vary depending on monitor settings.

§6. Prices, currencies, VAT & invoicing

Prices are displayed in the currency of the site and include VAT (gross prices). For sales to other EU countries, VAT is charged at the rate applicable in the country of destination (OSS procedure).

Delivery costs are not included in the prices and are communicated to the Customer during the checkout process. VAT invoices are issued upon request.

§7. Placing orders & conclusion of contract

Placing an Order constitutes an offer to conclude a sales contract. The contract is concluded at the moment the Seller sends the Customer an order confirmation e-mail to the provided address.

The Seller reserves the right to refuse to fulfil an Order for valid reasons (including, but not limited to: out-of-stock items, payment issues, pricing errors).

§8. Delivery, costs & risk

Deliveries are made within the European Union. The Customer bears the delivery costs in accordance with the chosen option. The risk of damage to or loss of the Goods passes to the Customer at the moment the Seller hands the shipment over to the Carrier.

§9. Right of withdrawal

A Customer who is a consumer has the right to withdraw from the contract without giving any reason within 14 calendar days.

The Goods must be returned to the Seller's address in an undamaged condition. The refund will be issued within 14 days of receiving the returned Goods. This right does not apply to sealed goods (e.g. opened nicotine pouch packaging) that cannot be returned for hygiene reasons once unsealed.

§10. Complaints & warranty

Complaints should be submitted by e-mail to: contact@whitesnus.com. Selected Goods may be covered by a manufacturer's warranty, which does not affect the Customer's statutory rights.

§12–§14. Intellectual property & force majeure

All content within the Service is the property of the Seller. Neither party shall be liable for failure to perform obligations caused by force majeure.

§15–§16. Amendments & final provisions

The Seller reserves the right to amend these Terms & Conditions. Matters not regulated herein are governed by the applicable provisions of law.
